Introduction

These Terms of Service (“Terms”) govern your use of the DenaHome website (the “Website”) and any purchase of goods from DenaHome. DenaHome is a trading name of Denaventures Ltd, a company registered in England and Wales. By accessing our Website or placing an order, you agree to be bound by these Terms. Please read them carefully. If you do not agree with any part of these Terms, you should not use the Website or purchase goods from us. These Terms do not affect your statutory rights as a consumer under UK law.

Definitions

  • DenaHome, Company, We, Us, Our: Refers to Denaventures Ltd, trading as DenaHome, including our employees, agents, and affiliates.
  • You, Your, Customer: The individual accessing our Website or purchasing goods from DenaHome.
  • Goods, Products: The physical items offered for sale on the DenaHome Website.
  • Order: Your request to purchase Goods from DenaHome through the Website.
  • Contract or Agreement: The legally binding agreement between you and DenaHome formed when we accept your Order.
  • Website: The DenaHome online store (and any subdomains) operated by Denaventures Ltd.
  • Privacy Policy: Our separate policy detailing how we collect, use, and protect personal data (in accordance with UK Data Protection Act 2018 and UK GDPR).
  • Refund Policy: Our separate policy (if any) outlining procedures for cancellations, returns, and refunds, which are in line with these Terms.

Eligibility

You must be legally capable of entering into a binding contract to use our Website and purchase Goods. By using the Website or placing an Order, you represent and warrant that: (a) you are at least 16 years old; and (b) if you are under 18 years old, you have the consent of a parent or legal guardian to use the Website and to place Orders. We reserve the right to ask for proof of age or identity at any time to verify compliance with this requirement. We do not knowingly allow any person under 16 to register an account or make purchases. If we discover that an Order was placed by a person under 16 (or under 18 without necessary consent), we will cancel the Order and issue a refund of any amounts paid.

User Accounts

Creating a user account on our Website is optional but recommended for a faster checkout and access to order history. If you choose to register an account, you agree to provide truthful, accurate, and up-to-date information during the registration process and to update such information promptly if it changes. You are responsible for maintaining the confidentiality of your account login credentials and for restricting access to your account. Account Security: You must keep your password secure and not share it with anyone. You are responsible for all activities that occur under your account. If you suspect any unauthorized use of your account or a security breach, you must notify us immediately.

By creating an account, you agree that you will not impersonate any other person or entity, and you will not use another user’s account without permission. Each customer is generally allowed to create only one account. We reserve the right to suspend or terminate your account (and your access to the Website) at any time if, in our reasonable view, you are in breach of these Terms or if we suspect fraudulent or abusive activity. Account holders are responsible for ensuring that all information in their account (including contact and shipping details) is correct and up to date at all times.

Order and Contract Formation

When you place an Order on our Website, you are making an offer to buy the selected Goods from us in accordance with these Terms. After you submit an Order, we will usually send you an order acknowledgment email to confirm that we received your Order. Please note: this acknowledgment is not yet an acceptance of your Order, but simply a confirmation that your request was received. The binding contract of sale (the “Contract”) between you and DenaHome is formed only when we accept your Order by dispatching the Goods to you (or by sending you a confirmation email explicitly stating that the Order is accepted), whichever occurs first. We reserve the right to decline or cancel any Order before a Contract is formed, for any reason.

Order Refusals: In certain circumstances, we may refuse or cancel your Order after it has been placed, for example if:

  • The Goods you ordered are out of stock or no longer available.
  • There is an obvious error in the pricing or description of the Goods on our Website.
  • We are unable to obtain authorization for your payment, or payment is not completed.
  • We suspect the Order may be fraudulent or unauthorized (e.g. suspected use of a stolen payment card).
  • You do not meet the eligibility criteria or have otherwise breached these Terms.

If we refuse or cancel an Order for which you have already paid, we will notify you of the cancellation and refund any payment you have made for that Order as soon as possible (in any event within 14 days). All Orders are subject to availability of the Goods and confirmation of the Order price. We reserve the right to withdraw or discontinue any Goods from the Website at any time before we accept your Order, without liability.

Payment Terms (via Stripe)

All payments for Orders must be made at checkout through our third-party payment processor, Stripe. We accept major debit and credit cards that are supported by Stripe (such as Visa, MasterCard, American Express, Discover, and others). By placing an Order, you authorize us (and Stripe on our behalf) to charge your selected payment method for the total amount of your Order (including any applicable taxes or charges).

  • Timing of Charge: Payment will be processed and charged at the time you place your Order, unless explicitly stated otherwise. If your payment cannot be processed (e.g. the transaction is declined or not authorized by the card issuer), your Order will not be accepted, and we will not be liable for any delay or non-delivery resulting from this.
  • Prices: All prices on our Website are listed in Great British Pounds (GBP). Unless otherwise stated, prices include all applicable UK taxes (including VAT) and charges. The price you see at checkout is the total price you will pay for the Goods. We do not add any surcharges for using a credit/debit card.
  • Stripe Payments: Stripe securely handles your payment information. We do not receive or store your full credit card details on our servers – all card transactions are processed through Stripe’s secure platform, which is PCI-DSS compliant. This means your card data is encrypted and handled safely. Once your payment is completed, we receive a confirmation of payment and can proceed with fulfilling your Order.
  • Payment Disputes: In the event you believe you were charged in error or encounter any issues with payment, please contact us. Any refunds or reversals will be made in accordance with our Cancellation and Refund policies (see below) and Stripe’s procedures for chargebacks or refunds. We reserve the right to refuse to process payments from any person or entity, or to cancel any transaction, if we suspect unauthorized or fraudulent activity.

Delivery and Shipping (UK Only)

We currently ship only to addresses within the United Kingdom. We do not offer international shipping. All Orders ship with free standard delivery – you will not be charged any separate shipping fees for standard delivery of your items within the UK.

  • Dispatch Times: We aim to process and dispatch Orders promptly. In most cases, Orders are prepared and handed over to our carrier within 2 business days after we confirm your Order. Once dispatched, standard delivery typically takes an additional 5–7 business days to reach you. (Total delivery time from placing an Order is usually around 7–9 days.) Please note these timeframes are estimates, not guarantees, and actual delivery times may vary due to factors outside our control. If there is an unexpected delay, we will do our best to inform you. In any event, if we cannot deliver your Goods within 30 days of your Order (and you haven’t agreed to a longer delivery period), you have the right to cancel the Order for a full refund.
  • Delivery Method: We will select a reputable courier or postal service for delivery of your Order. Delivery will be made to the address you provide during checkout, so please ensure the address is complete and accurate. We are not responsible for delays or failures in delivery if the address provided was incorrect or incomplete. If you realize you made an error in your address, please contact us as soon as possible.
  • Title and Risk: Ownership of the Goods you purchase passes to you once we have received full payment for the Goods and the Goods are delivered to you. The risk of loss or damage to the Goods remains with us until the Goods are delivered to you (or a person identified by you to take possession on your behalf). This means we are responsible for the Goods during transit, and if the Goods are lost or damaged before they reach you, we will arrange for a replacement or refund. (Exception: If you — rather than DenaHome — arrange for your own courier to collect the Goods from us, then risk would transfer to you upon that collection) Once delivery is completed, the Goods are at your risk and you will be responsible for them.
  • Failed Delivery & Incorrect Address: If a delivery fails because you provided an incorrect address or you were not available to accept the package, please follow the instructions left by the courier to rearrange delivery or collect your parcel. If an Order is returned to us due to an incorrect address or failure to collect, we may contact you to arrange re-delivery. We reserve the right to charge you for any reasonable additional shipping costs incurred due to such circumstances.
  • Delivery Problems: We want your products to reach you safely. If you do not receive your Order within the expected timeframe, or if the package arrives significantly damaged, please contact us as soon as possible so we can assist. In the rare event your package is lost in transit or substantially delayed, we will work with the courier to locate it or send a replacement. Remember that under UK consumer law, the retailer (DenaHome) is responsible for ensuring the goods are delivered to you safely – we cannot simply blame the courier for loss or damage in transit. We will make things right if something goes wrong with the delivery.

Cancellations and Returns

Your 14-Day Right to Cancel (Change of Mind)

If you purchase Goods from our Website, you have a legal right to cancel your Order for any reason (or no reason at all) within 14 days from the day you receive the Goods. This is often referred to as the “cooling-off period.” If your Order consists of multiple items delivered on different days, the 14-day period runs from the day you receive the last item of the Order. To exercise your cancellation right, you must inform us of your decision to cancel by a clear written notice (for example, an email to our contact address) within this 14-day window. You do not have to provide a reason for cancellation, and we will not penalize you for exercising this right.

  • No Physical Return Required: We do not require you to physically return the Goods to us if you cancel within the 14-day cooling-off period. You may keep, donate, or dispose of the Goods at your discretion. (This policy is intended to simplify the process for you; it goes beyond the minimum legal requirements, which would normally allow us to ask for the items to be returned.) Please note that until you decide to dispose of or give away the goods, you must take reasonable care of them.
  • Refund Process for Cancellations: If you cancel your Order within the 14-day period, we will refund 100% of the amount you paid for the Goods, including any standard delivery charges (if any were charged). We will make the reimbursement without undue delay, and in any event within 14 days from the day you informed us of your cancellation. The refund will be issued back to the same payment method you used for the Order, unless we have expressly agreed otherwise. There are no restocking fees or penalties for legitimate cancellations. (If you paid for an enhanced delivery service, we will only refund the equivalent of our basic standard delivery cost, per UK regulations) We will send you an email confirmation once your refund has been processed.
  • Effect of Cancellation: Once you notify us of cancellation, the Contract between us is terminated. You should not continue to use the Goods (if you have already received them) beyond what is necessary to inspect and decide if you want to keep them. We will deactivate any digital codes or vouchers (if any were provided with the purchase) upon cancellation. Since we do not require a return, you do not need to send the product back; however, you must cease use of it. (If you choose to return it to us at your own cost, please contact customer service for a return address and instructions.) We reserve the right to refuse a cancellation request if it falls outside the 14-day window or if it concerns goods exempt from the cancellation right (see below).
  • Exceptions: Certain products are exempt from the 14-day cancellation right under the Consumer Contracts Regulations. These include perishable goods, sealed items unsealed by you that are not suitable for return for health or hygiene reasons, customized or made-to-order items, etc. If any such exemption applies to Goods we sell, it will be noted on the product page. Otherwise, the 14-day return policy applies to our Goods generally. (Currently, most or all products on DenaHome are standard goods eligible for cancellation.)

After 14 Days – Faulty or Misdescribed Goods

Our 14-day “change of mind” refund policy does not apply beyond the initial 14 days after delivery. However, if the Goods you purchased are faulty, damaged, or not as described, you have additional rights under consumer law. In the event you received an item that is defective or does not match its description on our Website, please notify us as soon as possible (preferably within 30 days of delivery). We will work with you to resolve the issue by either:

  • Offering a full refund of the purchase price; or
  • Providing a replacement or repair (if stock is available and if you prefer this option).

If you report a problem with the product within 30 days of receiving it, you are generally entitled to reject the faulty goods and get a full refund under the Consumer Rights Act 2015. If a defect is reported after 30 days but within six months, we are entitled to attempt a repair or replacement, but if that is impossible or unsuccessful, you may then be entitled to a refund. All refunds for faulty or misdescribed goods will include any shipping charges you paid, and will be processed as swiftly as possible. These rights are in addition to your cancellation right above.

No Return for Faulty Items: Just as with change-of-mind cancellations, we typically do not require you to return a faulty item physically to us. We may ask for evidence of the fault (for example, a photo of the damage or a description of the defect) to evaluate the issue. In most cases of confirmed faults or misdescription, we will simply refund you or send a replacement without a need for return. If we do, on occasion, require the item back for testing or inspection, we will arrange the return at our expense.

Summary of Key Rights: The Goods you purchase from us must be of satisfactory quality, fit for purpose, and as described – this is guaranteed by the Consumer Rights Act 2015. Nothing in these Terms will affect or reduce your legal rights. In short, if we’ve let you down by delivering faulty or misdescribed goods, we will make it right in accordance with the law and our policies. User Interactions (Reviews, Comments and Acceptable Use)

We may allow users to interact on our Website in various ways, such as posting product reviews, ratings, comments, or participating in forums or social media channels related to DenaHome. If you choose to submit any content (for example, a review of a product) or otherwise engage with our Website beyond just browsing and purchasing, you agree to the following rules of acceptable use:

  • Lawful and Respectful Content: You must ensure that any content you post or submit is lawful, appropriate, and respectful. You may not post or transmit any content that is illegal, obscene, vulgar, pornographic, hateful, racist, sexist, harassing, defamatory, libelous, invasive of someone’s privacy, or otherwise objectionable. In short, content should be civil and relevant to the forum (e.g. genuine product feedback in a review). We have zero tolerance for hate speech or any form of discrimination or abuse.
  • No Infringing Material: You may only post content that you have the right to post. Do not upload anything that violates the intellectual property or privacy rights of others (e.g. do not copy text from someone else’s review or include images you do not have rights to use). You are responsible for the content you contribute. By posting content on our Website, you represent that you own or have permission to use everything in that content.
  • Prohibited Conduct: You must not use the Website for any fraudulent or malicious activities. Specifically, you agree not to: upload or distribute any viruses, malware or harmful code; attempt to hack or gain unauthorized access to any part of our Website or its systems; probe or test the vulnerability of our security measures; send spam, unsolicited or bulk electronic communications to other users or to us through the site; or engage in any activity that could disable, overburden, or impair the proper working of the Website (such as a denial-of-service attack). Any attempt to interfere with the technological operations of the site or to bypass its security is strictly prohibited.
  • No Impersonation or False Information: You must not impersonate any person or entity, or falsely state or misrepresent yourself (including pretending to be a representative of DenaHome or Denaventures Ltd if you are not). All information you provide, whether in a review, account details, or communications with us, must be truthful and accurate to the best of your knowledge. Misleading other users or DenaHome staff is not permitted.
  • Moderation and Removal: We reserve the right (but not the obligation) to monitor user-submitted content and interactions. We may, at our discretion and without notice, edit or remove any user content that we believe violates these Terms or is otherwise objectionable. This can include reviews that contain prohibited content or language, off-topic comments, or any content we deem unhelpful or fake. We may also suspend or terminate your ability to post content or interact on the site if you violate these rules. However, we are not liable for content posted by users, and we do not pre-approve all user content. If you see something that you believe violates these Terms or the law, please report it to us.
  • License to Use Your Content: By submitting or posting any content on our Website (such as a review or a testimonial), you grant Denaventures Ltd a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, adapt, publish, translate, distribute, and display that content in connection with operating and promoting our Website and business. This means, for example, we may choose to display your product review on the product page, or use a snippet of your testimonial in our marketing materials. We will not owe you any compensation for such uses. You retain ownership of your content and can reuse it yourself, but you give us the right to use it as described. If you do not agree with this, please do not submit content to our site.
  • User Responsibility: You are solely responsible for the content you post and for your interactions on the Website. DenaHome does not endorse any user-generated content, and content posted by users does not reflect our opinions or positions. We will not be responsible for any loss or damage arising from user content or interactions between users. Use common sense and caution when interacting online. If we terminate your user account or access due to violation of these rules, you may not create a new account or attempt to circumvent the ban.

Limitation of Liability

Use of our Website and purchase of Goods is at your own risk, but with important limitations on our liability to you as described below. Nothing in this section (or elsewhere in these Terms) is intended to limit your rights as a consumer or to exclude any liability that we are not permitted to exclude under law.

  • No Indirect or Consequential Damages: To the fullest extent permitted by applicable law, DenaHome (Denaventures Ltd) will not be liable for any indirect, incidental, special, or consequential losses or damages arising out of or in connection with your use of the Website or purchase of any Goods. This means that, for example, we are not responsible for losses such as lost profits, lost revenue, lost business opportunities, loss of data, or inconvenience or disappointment that are not a direct result of our breach or negligence. Our Goods are sold for domestic and private use – we do not accept any liability for business losses (if you use the Goods for commercial purposes, we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity).
  • Events Outside Our Control: We are not responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by events outside our reasonable control. Such events may include, for example, acts of God, natural disasters, war, terrorism, civil commotion, pandemics, government actions, strikes or labor disputes, power or utility failures, fire, flood, severe weather, or failure of third-party delivery services. If such an event occurs that affects our ability to fulfill your Order or otherwise perform our obligations, we will contact you as soon as reasonably possible to notify you, and our obligations will be suspended for the duration of the event. We will arrange a new delivery date with you after the event is over, or you may cancel the Order for a refund if appropriate.
  • Liability Cap: Except for the specific circumstances outlined below under “Unlimitable Liability,” our total aggregate liability to you for all losses, damages, and claims arising out of or in connection with your use of the Website or purchase of Goods, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, will not exceed the total amount you paid to us for the Goods in question. If your claim does not relate to a specific Good (for example, a claim arising from the use of the website itself), our total liability shall not exceed £100 (one hundred pounds). These limitations reflect the allocation of risk between us – since our products are not highly priced luxury items, this cap is generally equal to or greater than the value of your transaction.
  • Unlimitable Liability: We do NOT exclude or limit in any way our liability for: (i) death or personal injury caused by our negligence (or the negligence of our employees, agents or subcontractors); (ii) fraud or fraudulent misrepresentation; or (iii) any other liability which cannot be legally limited or excluded under English law. For example, under the Unfair Contract Terms Act 1977 and the Consumer Rights Act 2015, a business cannot exclude liability for death or injury resulting from its negligence, or liability for supplying unsafe or defective products, to a consumer – any attempt to do so would be unenforceable. Any such disclaimers in these Terms are automatically modified to comply with applicable law.
  • No Effect on Statutory Rights: We acknowledge that as a consumer you have certain rights granted by law (statutory rights), such as rights relating to the quality of the goods, fitness for purpose, and the right to receive a refund for faulty goods, as provided under the Consumer Rights Act 2015, and rights to cancel certain contracts under the Consumer Contracts Regulations 2013. Nothing in these Terms is intended to affect or reduce your statutory rights as a consumer. You will still be entitled to the full benefit of those rights, even if they are not specifically mentioned in these Terms. In the event that any provision of these Terms is found to be invalid or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, or severed if necessary, and the remainder of the Terms will continue in full force.

Intellectual Property

All content and materials on the DenaHome Website – including but not limited to text, descriptions, product listings, photographs, graphics, logos, icons, images, audio clips, video clips, downloads, and software – are the intellectual property of Denaventures Ltd or our content suppliers/licensors, and are protected by copyright, trademark, and other applicable intellectual property laws. The compilation of all content on this site is the exclusive property of Denaventures Ltd.

  • Limited License for Personal Use: We grant you a limited, non-transferable license to access and make personal use of the Website and its content for the purposes of shopping or learning about our products. You may not reproduce, copy, sell, resell, modify, publish, distribute, or exploit the Website or any portion of its content for any commercial purpose without our express written permission. This includes scraping or using any data mining, robots, or similar data gathering tools to extract content from the site. You may not frame or use framing techniques to enclose any trademark, logo, or other proprietary information on the site without consent. You may, however, print or download pages for your personal, non-commercial use, provided you do not modify them and you retain any proprietary notices.
  • Trademarks: “DenaHome”, the DenaHome logo, and any other trademarks or service marks displayed on the Website are trademarks of Denaventures Ltd (or of third parties who have licensed their marks to us). You are not permitted to use these trademarks without our prior written approval. Any unauthorized use of our trademarks is strictly prohibited.

We reserve the right to update our Privacy Policy from time to time to reflect changes in law or our practices; significant changes will be communicated or highlighted on our site.

Governing Law and Jurisdiction

These Terms of Service, and any Contract between you and DenaHome for the sale of goods, and any disputes or claims arising out of or in connection with them, are governed by the laws of England and Wales. This means that your use of the Website and any purchase contracts will be interpreted and enforced in accordance with English law (which for consumers includes relevant UK consumer protection laws in force).

In the event of a dispute, we hope to resolve any concerns quickly and amicably through our customer service team. However, if a legal dispute arises that cannot be resolved informally, it will be subject to the exclusive jurisdiction of the courts of England and Wales. By accepting these Terms, you are agreeing that those courts will have authority to settle any disputes (unless another jurisdiction is mandatorily required by law, as explained next).

Consumers in Scotland or Northern Ireland: If you are a consumer resident in Scotland or Northern Ireland, you may additionally bring legal proceedings in your local courts. The clause above does not take away any rights you may have under consumer protection laws to rely on the law or courts of your home part of the UK. For the avoidance of doubt, we do not currently sell outside the UK, so issues of international law should not arise; but if you are accessing this Website from outside the UK, you do so on your own initiative and are responsible for compliance with any local laws.

Nothing in this section limits your statutory rights to alternative dispute resolution or other mechanisms that may be available to you under law (for example, EU consumers – if we were selling to the EU – might use the EU Online Dispute Resolution platform). These references are provided for completeness, but as a UK-focused business we primarily operate under English law.

Changes to These Terms

We may revise or update these Terms of Service from time to time to reflect changes in our business practices, changes in applicable laws, or for other legitimate reasons. Whenever we update the Terms, we will post the new version on the Website and update the “Last Updated” date at the top. It is your responsibility to review the Terms periodically to ensure you understand the terms and conditions that apply to your use of the Website and purchases.
